Legal seizures can be executed through various means, but the most common method involves seizing bank accounts, salaries, or movable assets such as vehicles or valuable items. We are only authorized to execute seizures upon receipt of a judgment ordering the other party to make payment, and if they fail to do so voluntarily within the specified time frame. In cases where we proceed with the seizure of movable assets, these assets will be sold through a judicial sale. Alternatively, a payment arrangement may be negotiated if accepted by the client. Our responsibility is to identify the optimal solution based on the circumstances and the client's requirements. It's worth noting that a judgment remains valid for a period of ten (10) years.

At QCO, our objective is to manage your judgment effortlessly, tailored to your requirements. We take pride in optimizing seizure outcomes professionally while adhering to the applicable laws and regulations.

A legal eviction can be either residential or commercial. Residential evictions typically result from decisions made by the Administrative Housing Tribunal, while commercial evictions are associated with judgments issued by courts of the applicable jurisdiction.

In a residential eviction, the process begins with a legal warning given to the tenant, providing a notice period of five (5) days. Following this period, the bailiff can initiate procedures to remove the tenant, change the locks, and handle the removal of belongings in accordance with city by-laws or at the discretion of the bailiff.

For commercial evictions, once a court judgment has been obtained, the bailiff can proceed legally. After issuing the required notice, the bailiff will undertake the eviction process, including removing the tenant, changing locks, and managing the belongings accordingly.

At QCO, our approach to evictions aims to be as seamless and professional as possible. Our goal is to receive a judgment from a client and handle all aspects of the eviction process from beginning to end.

A bailiff report is regarded as a type of testimony that holds weight in court and is highly reliable, given the source is an officer of the court. Additionally, a judge has the authority to request a report or written declaration from a bailiff. In compiling their report, the bailiff considers all his senses, including what they see, hear, and smell. Reports from bailiffs can be prepared using various methods, such as written documentation, video recordings, photography, and/or audio recordings.

At QCO, we guarantee that each bailiff report will be meticulously crafted with utmost care. Our objective is to provide you with a comprehensive report, ensuring you have the strongest possible evidence at your disposal.

Once a judgment is rendered, you can question the debtor about his or her assets. The Bailiff can examine the debtor and/or any other party who is able to provide information on the debtor’s assets and liabilities, conditional upon that person’s consent or if the creditor or bailiff has obtained the court’s authorization. The Bailiff can ask any questions which are relevant to the determination of the debtor’s assets and liabilities and the debtor can be required to provide supporting documentation.

At QCO, our post-judgment interrogation service merges professionalism with efficiency, ensuring the utmost utilization of the limited time available to evaluate defendants' credibility and optimize information and assets. Every interaction is recorded, guaranteeing transparency and accountability.

The judicial sale is particularly important in the execution process. It involves rendering a judgment followed by an executory measure of seizure. Once the seizure is executed, the defendant is compelled to either pay the debt in full, including bailiff fees, or agree to a payment plan. The sale of movable property is usually conducted through an auction. Another method is by agreement, where offers are received, and a deadline is set for the sale. The third method is a call for tenders. The sale of immovable property is also significant and necessary in certain cases. This process is extensive, involving several steps, but it always has an immediate impact.

At QCO, we strive to ensure our clients achieve the most favorable outcomes, always considering costs and judicial proceedings for sales. Our goal is to recover all amounts owed, including bailiff fees, while providing a "turnkey" solution.

This approach is commonly employed in scenarios involving auto dealerships, leasing companies, and insolvent debtors, particularly when there are outstanding and overdue amounts. Opting for a voluntary transfer of assets is advantageous as it helps save on judicial and bailiff fees typically associated with asset recovery.

At QCO, we take pride in recovering unpaid assets, and carrying out this process brings us great satisfaction within our field. Possessing a distinct negotiation skill, we would make an excellent team in handling such mandates.

Attempting to recover any form of debt, whether it's an unpaid bill, rent, or unfulfilled contract, before it escalates to a legal dispute is the most efficient method to reclaim owed funds. This approach saves money, time, and ensures legal compliance for all involved parties. For a small management fee and a percentage of the recovered amounts, amicable collection presents an excellent opportunity for both parties to resolve disputes.

At QCO, leveraging our extensive knowledge and experience in this domain, we prioritize executing such mandates efficiently. Given the substantial legal and judicial costs involved, our focus is on mitigating these expenses and resolving issues swiftly. While it's undoubtedly a delicate mandate, it's always worth pursuing.
